Terms of Service

These Terms govern your use of cocktailpoolsflorida.com and any design, installation, or DIY kit order placed with Cocktail Pools Florida ("we", "us"). By placing an order you agree to these Terms.

1. Scope of service

We offer (a) free pool design via our configurator, (b) turnkey installation of a 24-inch architectural plunge pool at qualifying Florida addresses, and (c) precision DIY kit shipping nationwide. The specific deliverables, price, and timeline for your order are confirmed at checkout.

2. Orders and acceptance

Submitting a configuration and payment constitutes an offer to purchase. We accept your order when we send written confirmation. We reserve the right to decline orders, including for site ineligibility, capacity, or pricing errors. If we decline, we refund in full.

3. Pricing, taxes, and payment

Prices are shown in USD and exclude applicable Florida sales tax, which is calculated at checkout. Payment is processed by Stripe. We do not store full card details.

4. Permit exemption — important

Our pools are designed to fall within Florida's above-ground recreational vessel exemption (the "24-inch rule"). We provide a stamped exemption letter with every order. You as the property owner are ultimately responsible for compliance with all local building codes, setback requirements, HOA covenants, and any future inspections. Our letter documents the exemption basis; it is not a building permit and we make no warranty that any specific municipality, building official, or HOA will accept it without question.

5. HOA / ARC submissions

We provide a pre-filled HOA packet (cover letter, statute citation, materials list, site plan) sized for typical Florida ARC boards. Board approval is at the board's sole discretion and is not guaranteed. We do not refund deposits if your HOA denies a submission that we cannot reasonably remedy.

6. Installation timelines

Turnkey installs are scheduled into a 2–4 week window from order confirmation, with the actual on-site build completing within 48 hours of crew arrival. Schedules are estimates and may shift due to weather, crew availability, HOA timing, or site conditions. We are not liable for incidental costs caused by reasonable schedule changes.

7. Shipping (DIY kits)

Kits ship via freight from our Florida warehouse, typically within 3–4 weeks of order. Risk of loss transfers on delivery. Inspect the kit at delivery and report any visible damage on the bill of lading.

8. Warranty

Materials: 1 year against manufacturing defects from delivery date. Workmanship (turnkey installs only): 2 years against installation defects from completion date. Excluded: owner-caused damage, freeze damage, neglect of routine maintenance, ground settlement outside our control, chemical staining from improper water chemistry, and any modifications made by the owner or a third party. 9. Cancellations and refunds

  • Before exemption letter is issued: full refund minus payment processing fees.
  • After exemption letter is issued / kit enters production: deposit becomes non-refundable; balance refundable minus already-incurred materials and engineering costs.
  • After install crew is dispatched or kit ships: no refund.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from or related to your order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including loss of use, loss of property value, or HOA fines.

11. Governing law

These Terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Florida.

12. Changes

We may update these Terms. Material changes apply only to orders placed after the updated effective date.
